Clearway - High court writ of possession enforcement

What is a High Court Writ of Possession?

High Court Writs of Possession is a court order which grants possession of a property back to its rightful owner on the grounds that it has been unlawfully occupied by someone else. This type of order is issued when a landlord or other legal owner of a property requires the removal of trespassers or squatters.

In most cases, High Court Writs of Possession give the possessor a certain period of time to vacate the premises. If they do not comply, either the writ can be enforced by the police or security officers in order to remove them from the property. That’s where Clearway Comes in.

Frequently asked questions

The High Court Writ of Possession is a powerful legal tool, which can help protect people’s rights in cases of unauthorised occupation and help to ensure that landlords do not suffer financially due to the actions of trespassers or squatters. It can also be used as an effective deterrent to prevent such activities from happening in the first place.

An enforcement agent can be hired at any time during the process of a High Court Order of Writ, however, it is most common to hire one prior to the order being issued. This ensures that the enforcement team is in place to carry out their duties as soon as possible.

Yes, enforcement agents must obtain the necessary approval before they can act on a High Court Order of Writ. Typically, this involves an application to the court or local authority in order to demonstrate that the proposed action is lawful and acceptable under the law. The court or local authority will consider a range of factors including whether there is a valid claim to the property and whether the enforcement agent has sufficient experience to carry out our duties.

Once the High Court Order of Writ is issued, the enforcement team will then be authorised to take action in order to remove the squatters from the property. This usually involves a physical removal of the squatters from the premises, as well as securing any possessions they may have left behind. After this has been completed, the enforcement team will then be able to hand back control of the property to its rightful owner.
